Terms of Service

PLEASE READ THESE TERMS CAREFULLY before using our website, mobile application, or services. By accessing or using any King Roofing platform, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Introduction and Scope

Welcome to King Roofing, operated by King Construction and Restoration LLC, a Utah limited liability company ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of:

  • Our website located at www.kingroofco.com (the "Website");
  • Our mobile application(s) available on the Apple App Store and Google Play Store (the "App");
  • Our AI-assisted communication platform, including voice, SMS, and email channels (the "Claudia Platform");
  • Any other digital services, tools, or platforms we operate (collectively, the "Services").

These Terms also govern your general business interactions with King Roofing. All roofing, restoration, and construction services are provided under a separate written Service Agreement, which governs scope of work, pricing, timelines, and warranties. In the event of any conflict between these Terms and a signed Service Agreement, the Service Agreement controls.

1.1 Key Definitions

  • "App" means any iOS or Android mobile application published by King Roofing.
  • "Claudia Platform" means our AI-powered communication system that may handle inbound and outbound calls, SMS messages, and email on our behalf.
  • "Content" means all text, data, images, video, audio, and other materials made available through the Services.
  • "Personal Data" means any information that identifies or could reasonably identify you as an individual.
  • "Service Agreement" means a separate written contract executed between you and King Roofing for specific roofing or restoration services.
  • "User" means any individual who accesses or uses the Services.

2. Company Licensing and Compliance

King Construction and Restoration LLC d/b/a King Roofing is a licensed roofing and restoration contractor operating in multiple states. Our operations and licensing include:

King Roofing is a GAF Master Elite Certified contractor. We obtain all required permits prior to work commencement and comply with all applicable state and local building codes, inspection requirements, and insurance regulations.

3. Eligibility and Acceptable Use

3.1 Age Requirement

You must be at least 18 years of age to use our Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding agreements. Our Services are not directed to children under 13, and we do not knowingly collect Personal Data from children under 13. If we discover we have collected data from a child under 13, we will delete it promptly. If you believe we have inadvertently collected such data, please contact us at admin@kingroofco.com.

3.2 Account Registration

Some features of the App or Website may require account registration. You agree to provide accurate and complete information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.

3.3 Prohibited Activities

You agree not to:

  • Use the Services for any unlawful purpose or in violation of applicable federal, state, or local laws;
  • Attempt to gain unauthorized access to our systems, servers, databases, or other users' data;
  • Use automated tools (bots, scrapers, crawlers) to extract data without our prior written consent;
  • Introduce viruses, malware, or other harmful code into the Services;
  • Impersonate King Roofing, our employees, or any other person or entity;
  • Submit false, fraudulent, or misleading insurance claims or information;
  • Harass, abuse, or threaten other users or King Roofing personnel;
  • Reverse engineer, decompile, or disassemble any portion of the App or Services.

4. Mobile Application Terms

The following additional terms apply when you download or use our mobile application on iOS or Android devices.

4.1 Apple App Store — Additional Terms

If you download the App from Apple's App Store, the following terms apply in addition to these Terms:

  • These Terms are an agreement between you and King Roofing only, not with Apple Inc. Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support services for the App.
  • In the event of any failure of the App to conform to applicable warranties, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App, including: (a) product liability claims; (b) claims that the App fails to conform to any applicable legal or regulatory requirement; or (c) claims arising under consumer protection or similar legislation.
  • If a third party claims the App or your use of it infringes their intellectual property rights, Apple will not be responsible for the investigation, defense, settlement, or discharge of any such claim.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
  • You represent and warrant that you are not located in a country subject to a U.S. Government embargo or on any U.S. Government prohibited or restricted parties list.

4.2 Google Play Store — Additional Terms

If you download the App from the Google Play Store, the following terms apply in addition to these Terms:

  • Google LLC is not a party to these Terms. Google has no obligation to provide support or maintenance for the App.
  • Your use of the App is also subject to the Google Play Terms of Service.
  • Google Play's Data Safety section for the App accurately describes our data collection and handling practices as required by Google's policies.

4.3 App Permissions

The App may request the following device permissions to provide certain features:

  • Camera: To allow you to photograph roofing damage or upload project photos.
  • Photo Library / Media Access: To attach existing photos to your service inquiries or claims.
  • Location (when in use): To identify your address for service area verification and routing.
  • Microphone: To support voice-based features within the Claudia Platform.
  • Push Notifications: To send you appointment reminders, project updates, and service alerts.
  • Contacts (optional): Only if you choose to import contacts; we will not access contacts without consent.

You may grant or deny permissions at any time through your device settings. Denying certain permissions may limit the App's functionality.

4.4 Push Notifications

By enabling push notifications, you consent to receive messages from King Roofing on your device, including appointment reminders, project status updates, estimate notifications, and promotional offers. You may opt out at any time through your device notification settings or within the App's settings menu. Opting out of push notifications does not affect our ability to communicate with you via email or SMS (see Section 7 for SMS terms).

4.5 Offline Functionality

Certain App features may be available offline. However, data entered offline will sync to our servers when you reconnect. We are not responsible for data loss resulting from connectivity issues during the sync process.

4.6 App Updates

We may release updates to the App from time to time. You are encouraged to install updates promptly. Continuing to use an outdated version may result in limited functionality or security vulnerabilities. We may discontinue support for older App versions with reasonable notice.

5. Data Collection, Firebase, and Analytics

We use Firebase, a platform developed and operated by Google LLC, to power certain features of our App and Website. By using the App, you acknowledge and consent to the data collection and processing practices described in this Section.

5.1 Firebase Services We Use

We currently use the following Firebase services, which may collect data from your device:

All data collected by Firebase services is processed by Google LLC in accordance with Google's Privacy Policy. Firebase data may be stored and processed in the United States or other countries where Google operates facilities.

5.2 Advertising Identifier

On Android devices, Firebase Analytics may collect your Advertising ID (GAID). On iOS devices, Firebase Analytics may collect your IDFA if you have permitted ad tracking through Apple's App Tracking Transparency (ATT) framework. On iOS 14.5 and later, we will request your permission before accessing your IDFA. You may reset your Advertising ID or opt out of interest-based advertising through your device settings at any time.

5.3 Google Analytics for Web

Our Website uses Google Analytics (including Google Analytics 4), which uses cookies and similar technologies to collect data about your use of the Website. This may include your IP address (anonymized where required), browser type, pages visited, time spent, and referring URLs.

5.4 Data Retention — Firebase

Analytics data is retained in Firebase for a period of up to 14 months by default, after which it is automatically deleted. Crashlytics data is retained for 90 days. You may request deletion of your Firebase-associated data by contacting us at admin@kingroofco.com.

6. Meta / Facebook Advertising and Lead Forms

King Roofing runs advertising campaigns on Meta platforms, including Facebook and Instagram. This section describes how we collect and use data through these advertising activities.

6.1 Meta Pixel

Our Website may use the Meta Pixel (formerly Facebook Pixel), a snippet of JavaScript code that helps us measure the effectiveness of our advertising by tracking actions visitors take on our Website. The Meta Pixel may collect:

  • Pages you visit on our Website;
  • Actions you take (e.g., filling out a contact form, clicking a phone number);
  • Information about your browser, device, and IP address;
  • Whether you have previously interacted with our ads on Meta platforms.

6.2 Custom Audiences and Lookalike Audiences

We may upload hashed customer lists (e.g., hashed email addresses or phone numbers) to Meta to create Custom Audiences for targeted advertising. We may also use this data to create Lookalike Audiences to reach new potential customers with similar characteristics.

6.3 Meta Lead Forms

When you submit a lead form through a King Roofing advertisement on Facebook or Instagram, the information you provide — including your name, phone number, email address, and property address — will be transmitted to us through Meta's Lead Ads platform. By submitting a Meta Lead Form, you agree to be contacted by King Roofing via phone, email, or SMS using the information you provided. See Section 7 for SMS communication consent details.

6.4 Meta Ad Policies

All King Roofing advertisements on Meta platforms comply with Meta's Advertising Policies. Our advertisements are truthful, non-deceptive, and accurately represent our services, pricing, and geographic coverage. We do not run ads that discriminate in housing-related advertising based on protected classes, in compliance with the U.S. Fair Housing Act and Meta's Special Ad Category requirements.

6.5 Opt-Out of Meta Ad Tracking

You may control how Meta uses data about you for advertising purposes by adjusting your settings in the Facebook Ad Preferences tool.

7. Communications Consent — TCPA, SMS, and AI-Assisted Outreach

IMPORTANT: By providing your phone number to King Roofing — whether through our Website, App, Meta Lead Forms, or any other channel — you consent to receive communications as described in this Section. This consent is not a condition of purchasing any service.

7.1 SMS / Text Message Communications

By providing your mobile phone number and affirmatively opting in (e.g., checking a consent box, submitting a form, or texting a keyword to our number), you consent to receive recurring automated and/or manually dialed text messages from King Roofing to the number you provide. These messages may include:

  • Appointment confirmations and reminders;
  • Estimate and proposal notifications;
  • Project status updates (e.g., materials ordered, crew scheduled, job complete);
  • Insurance claim process updates;
  • Customer satisfaction follow-ups;
  • Promotional offers and seasonal service announcements.

Message frequency varies. Standard message and data rates may apply. You may opt out of SMS communications at any time by replying STOP to any message. After opting out, you will receive a single confirmation message. You may re-subscribe at any time by texting START. For help, text HELP or contact us at admin@kingroofco.com.

7.2 AI-Assisted Voice and SMS — The Claudia Platform

King Roofing operates an AI-powered communication platform we call "Claudia." Claudia may:

  • Handle initial inbound calls and provide information about our services, service areas, and scheduling;
  • Place outbound calls or send SMS messages to provide project status updates and follow-ups;
  • Send automated SMS updates at key project milestones;
  • Triage inbound inquiries and route complex issues to human team members.

When you interact with Claudia, you acknowledge that you may be communicating with an AI system rather than a human. Claudia will identify itself as an AI assistant when asked. Complex matters — including insurance negotiation, contract disputes, and billing concerns — are always escalated to a human team member.

Calls with Claudia and our human team may be recorded for quality assurance, training, and dispute resolution purposes. Where required by applicable law, you will be notified of recording at the start of the call.

7.3 TCPA Compliance

Our SMS and automated calling practices comply with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable regulations. Specifically:

  • We obtain prior express written consent before sending marketing texts or placing autodialed marketing calls to cell phones;
  • We do not place autodialed or pre-recorded calls to residential landlines without prior written consent for marketing purposes;
  • We honor opt-out requests (STOP commands and verbal requests) within 10 business days;
  • We maintain an internal Do-Not-Contact list and scrub against the National Do Not Call Registry for telemarketing calls;
  • We do not send commercial SMS messages between 9:00 p.m. and 8:00 a.m. in the recipient's local time zone.

7.4 Email Communications

By providing your email address, you consent to receive transactional emails from King Roofing, including project documents, estimates, invoices, and service confirmations. You may also receive marketing emails if you separately opt in. You may unsubscribe from marketing emails at any time by clicking the "Unsubscribe" link in any email or by contacting admin@kingroofco.com.

All email marketing complies with the CAN-SPAM Act, 15 U.S.C. § 7701 et seq. We do not use deceptive headers or subject lines and include our physical mailing address in all commercial emails.

8. Estimates and Service Agreements

8.1 Preliminary Estimates

Any estimates provided through the Website, App, phone, or initial inquiry — including AI-generated estimates — are preliminary and non-binding. Final pricing, scope of work, material specifications, and timelines will be determined following an in-person property assessment and will be documented in a written Service Agreement signed by both parties.

8.2 Written Service Agreement Required

No work will commence without a written Service Agreement. The Service Agreement will include: (a) detailed scope of work; (b) material specifications and brands; (c) project timeline; (d) total price and payment schedule; (e) warranty terms; and (f) insurance claim details where applicable.

8.3 Change Orders

If unforeseeable conditions arise during a project (e.g., concealed structural damage, material substitutions required by code, or scope additions requested by you), we will issue a written change order before proceeding. No additional work will be performed without your prior written or digital approval of the change order.

9. Payment Terms and Financing

9.1 Payment Schedule

Payment terms — including deposit amounts, progress payment milestones, and final payment dates — will be specified in your Service Agreement. We accept payment by check, ACH transfer, and major credit cards. Credit card payments may be subject to a processing fee as disclosed in your Service Agreement.

9.2 Late Payments

Payments not received within the timeframe specified in your Service Agreement may accrue interest at 1.5% per month (18% per annum) or the maximum rate permitted by applicable law, whichever is less. We reserve the right to suspend or demobilize work if payments are materially overdue, without liability for project delays resulting from such suspension.

9.3 Financing Options

King Roofing may offer or facilitate access to third-party financing options. Any financing offered through a third party is subject to that third party's terms and conditions. King Roofing does not guarantee approval for any financing product. Interest rates, fees, and repayment terms are determined solely by the financing provider. We are not a lender and do not provide financial advice.

9.4 Cancellations and Refunds

Cancellation requests must be submitted in writing to admin@kingroofco.com or via certified mail to our registered address. Cancellations made before materials are ordered and before work has commenced may receive a full refund of any deposit paid. Once materials have been ordered or work has commenced, deposits and payments made are generally non-refundable to the extent they reflect costs already incurred. Refund eligibility is determined on a project-by-project basis and will be described in your Service Agreement.

10. Insurance Claims Assistance

10.1 Scope of Assistance

King Roofing may assist homeowners in documenting storm or hail damage, preparing claim-related photo reports, and communicating with insurance adjusters regarding roofing scope. Our assistance is limited to documenting physical damage and advocating for fair material and labor scopes. We do not practice law and do not provide legal advice. We are not licensed public adjusters and do not act as your insurance representative.

10.2 Insurance Claim Accuracy

You agree to provide accurate and truthful information in connection with any insurance claim. Submitting false or inflated claims to your insurer is insurance fraud and is illegal. King Roofing will not document, estimate, or advocate for damage that does not exist. We reserve the right to refuse to participate in claims we believe are fraudulent or improper.

10.3 No Guarantee of Claim Approval

King Roofing cannot guarantee that your insurance carrier will approve any specific claim, scope, or dollar amount. Insurance coverage determinations are made solely by your insurer. King Roofing is not liable for any denied claim, partial approval, or coverage dispute between you and your insurer.

10.4 Assignment of Benefits

King Roofing does not require execution of an Assignment of Benefits (AOB) as a condition of providing services. Any AOB or direction-to-pay agreement must be explicitly agreed to in writing and is separate from these Terms.

11. Warranties and Disclaimers

11.1 Workmanship Warranty

King Roofing warrants that all roofing work will be performed in a workmanlike manner using materials specified in the Service Agreement. The specific warranty period and terms will be set forth in your Service Agreement. To file a warranty claim, submit written notice to admin@kingroofco.com describing the alleged defect. We will inspect the claim within a reasonable time. Warranty remedies are limited to repair or replacement of defective workmanship at our discretion.

11.2 GAF System Plus Warranty Eligibility

As a GAF Master Elite certified contractor, King Roofing may be eligible to register qualifying roofing systems for enhanced GAF manufacturer warranties, including the System Plus warranty. Eligibility for enhanced warranties depends on the specific materials selected, complete installation of a qualifying GAF system, and timely warranty registration.

11.3 Manufacturer Warranties

Roofing materials may be covered by separate manufacturer warranties. These warranties are the obligation of the manufacturer, not King Roofing. We will provide manufacturer warranty documentation upon project completion and will assist you in filing manufacturer claims, but we cannot guarantee manufacturer decisions.

11.4 Warranty Exclusions

Warranties do not cover:

  • Damage caused by misuse, neglect, or improper maintenance by the property owner;
  • Acts of God or extreme weather events beyond normal conditions for the applicable region;
  • Unauthorized modifications, repairs, or work performed by third parties after project completion;
  • Pre-existing conditions not within the scope of the Service Agreement;
  • Normal wear and tear;
  • Damage caused by other trades or contractors working on the property after our project is complete.

11.5 Website and App Disclaimer

THE WEBSITE AND APP ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE OR APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE WEBSITE AND APP IS AT YOUR OWN RISK.

12. Limitations of Liability and Indemnification

12.1 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, KING ROOFING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY SERVICE AGREEMENT, INCLUDING LOST PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR SERVICE INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO A SPECIFIC SERVICE AGREEMENT EXCEED THE TOTAL AMOUNT PAID BY YOU UNDER THAT SERVICE AGREEMENT. FOR CLAIMS ARISING FROM USE OF THE WEBSITE OR APP (UNRELATED TO A SERVICE AGREEMENT), OUR LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above limitations apply to the maximum extent permitted by applicable law.

12.2 Force Majeure

We are not liable for delays, failures to perform, or damages caused by events beyond our reasonable control, including: severe weather or natural disasters; supply chain disruptions or material shortages; labor strikes or disputes; government-ordered shutdowns or permit delays; changes in applicable laws or regulations; pandemics or public health emergencies; or acts of war or terrorism.

12.3 Customer Property Responsibilities

You agree to provide reasonable access to the property and ensure the work area is reasonably safe. You are responsible for removing or protecting personal property, vehicles, and landscaping near the work area. King Roofing exercises reasonable care but is not liable for incidental damage to items not disclosed or not reasonably protected before work begins. Any known hazards (e.g., fragile skylights, buried irrigation systems, recent landscaping) must be disclosed in writing before work commences.

12.4 Indemnification

You agree to defend, indemnify, and hold harmless King Roofing, its officers, directors, employees, agents, and contractors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or relating to: (a) your use of the Services in violation of these Terms; (b) any false or misleading information you provided to us or to your insurer; (c) your violation of applicable laws; or (d) your negligence or willful misconduct.

13. Privacy, Data Rights, and Consumer Privacy Laws

13.1 Privacy Policy

Your use of the Services is subject to our Privacy Policy, available at www.kingroofco.com/privacy-policy, which is incorporated by reference into these Terms.

13.2 Utah Consumer Privacy Act (UCPA)

The Utah Consumer Privacy Act, Utah Code Ann. §§ 13-61-101 et seq. (effective December 31, 2023), provides certain privacy rights to Utah residents. If you are a Utah resident, you have the right to:

  • Know whether we are processing your Personal Data;
  • Access your Personal Data that we have collected about you;
  • Delete Personal Data you have provided to us (subject to certain exceptions);
  • Obtain a copy of your Personal Data in a portable format;
  • Opt out of the processing of your Personal Data for targeted advertising or the sale of your Personal Data.

To exercise UCPA rights, submit a verifiable consumer request to admin@kingroofco.com or call (385) 450-5464. We will respond within 45 days. We will not discriminate against you for exercising your privacy rights.

13.3 Data We Collect and How We Use It

We collect Personal Data to: (a) provide and improve our Services; (b) communicate with you about your project; (c) process payments; (d) comply with legal obligations; (e) support insurance claim documentation; and (f) send marketing communications with your consent. We do not sell your Personal Data to third parties for their own independent marketing purposes.

13.4 Third-Party Data Processors

We share Personal Data with trusted third-party service providers to operate our business, including: JobNimbus (CRM); Firebase/Google (analytics, push notifications); Twilio (SMS/voice); ElevenLabs (AI voice synthesis); Meta Platforms (advertising); and payment processors. All third parties are bound by appropriate data processing agreements and are prohibited from using your data except as necessary to provide services to King Roofing.

13.5 Data Security

We implement commercially reasonable technical and organizational security measures to protect your Personal Data against unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the Internet or method of electronic storage is completely secure. In the event of a data breach affecting your Personal Data, we will notify you as required by applicable law.

14. Dispute Resolution

14.1 Governing Law

These Terms and any disputes arising out of or related to them shall be governed by the laws of the State of Utah, without regard to its conflict of law provisions, except where preempted by federal law.

14.2 Informal Resolution

Before initiating formal dispute proceedings, you agree to first contact King Roofing at admin@kingroofco.com to describe the dispute and allow us a reasonable opportunity (not less than 30 days) to resolve the matter informally.

14.3 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Services — including questions of arbitrability — shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Utah County, Utah, unless otherwise agreed. The arbitrator's decision is binding and may be entered as a judgment in any court of competent jurisdiction.

14.4 Class Action Waiver

YOU AND KING ROOFING EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14.5 Exceptions to Arbitration

Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the outcome of arbitration. Small claims court actions filed by either party in Utah County small claims court are also exempt from mandatory arbitration.

14.6 Venue for Litigation

For disputes not subject to arbitration, exclusive jurisdiction and venue shall lie in the state or federal courts located in Utah County, Utah. You consent to personal jurisdiction in those courts.

15. Intellectual Property

All content on the Website and App — including text, graphics, logos, photographs, project images, software, and compilations — is the exclusive property of King Roofing or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

18.2 Severability
